The California Department of Alcoholic Beverage Control Issued Advisories Concerning Alcohol Deliveries
The outbreak of COVID-19 caused the closure of bars and restaurants throughout California. This closure spurred a “marked increase” in alcohol deliveries according to the California Department of Alcoholic Beverage Control. Concerns over these deliveries caused the department to issue an advisory calling licensees’ attention to the following:
- “To remind licensees of their legal obligations relating to deliveries;
- To ensure licensees are aware that they are ultimately responsible for the delivery of the alcoholic beverage;
- That the Department’s recent enforcement actions have revealed that third-party delivery services are routinely alcoholic beverages to minors; and
- That many licensees, and the delivery services they use, are failing to adhere to a variety of other legal obligations.”
One of the biggest concerns of the department is the furnishing of alcohol to minors. Delivering alcohol to a minor can result in sanctions and criminal prosecution. Licensees are required to ensure that their delivery person regardless of whether it is a third-party or employee make sure that they are not in violation of California law.
Delivery of alcohol can also present challenges for someone who is struggling with addiction or dependence. During these times, it can be hard to resist the temptation to drink. Stress and anxiety over the pandemic and economy can lead to an increase in alcohol use. It is important to check in with yourself and others to make sure that you are remaining healthy.
